1. Introduction
These Terms & Conditions ("Terms") govern your access to and use of the modelsbythor website and the creative-technology services provided by modelsbythor — Tushar Vig ("modelsbythor", "we", "us", or "our"). By accessing this website, submitting an inquiry, or engaging us for a project, you confirm that you accept these Terms.
2. Our services
modelsbythor designs and develops digital products including Snapchat Lenses, Instagram and TikTok AR filters, WebAR experiences, AI chatbots and automations, websites, e-commerce stores, mobile apps, UI/UX design and 3D experiences. The exact scope, deliverables, timeline and price of any engagement are defined in a separate written proposal, quotation or statement of work agreed between you and us.
3. Quotes, proposals & project scope
- Quotations are valid for 30 days unless stated otherwise.
- Work begins once the proposal is accepted and any agreed advance payment is received.
- Requests that fall outside the agreed scope ("scope creep") may be quoted and billed separately.
- Each package includes a defined number of revision rounds; additional revisions may incur further charges.
4. Payments
Unless agreed otherwise, projects require an advance deposit before work commences, with the balance due on or before delivery. Larger projects may be split into milestones. Late payments may pause work and, where applicable, attract reasonable late fees. All fees are exclusive of any applicable taxes unless stated.
5. Client responsibilities
You agree to provide timely feedback, approvals, brand assets and any accounts or access reasonably required to deliver the project. You are responsible for ensuring that materials you supply (logos, images, copy, trademarks) do not infringe the rights of any third party, and you grant us a licence to use them for the purpose of the engagement.
6. Intellectual property
Upon full payment, ownership of the final, approved deliverables created specifically for you transfers to you, except for: (a) third-party assets, libraries, fonts or stock subject to their own licences; and (b) our pre-existing tools, code, frameworks and know-how, which remain ours and are licensed to you for use within the delivered work. We may showcase completed work in our portfolio and marketing unless you request otherwise in writing.
7. Third-party platforms
AR Lenses, filters and effects are published on and governed by third-party platforms such as Snapchat, Meta (Instagram/Facebook) and TikTok. We do not control these platforms and cannot guarantee approval, availability, reach, monetisation or continued support, all of which are subject to the platforms' own policies and changes.
8. Performance & results
Any figures, reach, plays, engagement or earnings referenced on this website reflect past results and are not a promise or guarantee of future outcomes for your project. Results depend on many factors outside our control.
9. Limitation of liability
To the maximum extent permitted by law, modelsbythor shall not be liable for any indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of any engagement shall not exceed the fees paid by you for that engagement.
10. Termination
Either party may terminate an engagement with written notice. On termination, you agree to pay for all work completed up to the termination date. Deposits and amounts for work already performed are non-refundable (see our Refund Policy).
11. Changes to these Terms
We may update these Terms from time to time. The version published on this page applies to your use of the website and any engagement entered into after it is posted.
12. Governing law
These Terms are governed by the laws of India, and the courts of Faridabad, Haryana shall have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights you may have.
